Booking Terms and Conditions

  • Length of Stay. The cottage can be booked for a min of 2 nights and a maximum of 21 days (subject to availability). For bookings of 2 weeks or more, an additional £45 will be charged for a mid week clean.

Booking Terms

By making a booking with Us through this website or otherwise, you agree to the following terms and conditions.

We have some standard rules that are designed to ensure that we comply with regulations relating to matters such as fire, health and safety, and to enhance the comfort and wellbeing of our guests. If you would like to check our conditions of stay please contact us. We reserve the right to terminate Your Booking immediately without being liable for any refund or compensation where You engage in unacceptable behaviour that causes a disturbance or nuisance to other guests or our neighbours. 'Yew Tree Cottage Westow' (Us/We) Terms of Business are as follows: These Booking Terms apply to the business named above (under the Booking with section of the Booking Confirmation and the Provider Information in the confirmation email) our officers, employees and agents () and the person or legal entity making the Booking or to whom We supply services in respect of the Booking (You/Your/Party Leader). These Booking Terms are governed by English law and apply to all Bookings except where We agree in writing other terms.

Bookings

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by post or email. Bookings are made and a contract between You and Us comes into effect when We accept a reservation from You. We will accept a reservation when We have confirmed Your reservation and received full payment of the total price quoted from You or in the event that we require a non-refundable deposit, when we have received full payment of the total value of the non-refundable deposit. You, as the Party Leader, must be able to enter into a legally binding contract and be over 18yrs to make a Booking. The party leader must be authorised to make the booking on the basis of these Booking Conditions by all other members of the party. By making the booking, the party leader confirms that he/she is so authorised and that all other party members agree that the booking is subject to these

Booking Conditions

The party leader is responsible for making all payments due to us. Methods of payment.We accept payment via Maestro, Solo, VISA Electron, VISA and MasterCard, PayPal, cheque or bank transfer, through our own website. If you use a third party booking agency you will be bound by their payment terms.

Payment and Deposits

Bookings made through our online booking system are provisional until confirmed by Us. The total amount payable to confirm the Booking is quoted as part of this booking. Payment needs to be received within 3 days of the Invoice Date. Bookings must be paid for using an acceptable and valid credit or debit card, bank transfer, PayPal. When you book you should pay the deposit or full amount then due(plus any insurance premiums payable) by debit or credit card.

The balance must be received by us no less than 6 weeks before the start of your arrangements. However, if you book less than 6 weeks before the start of your arrangements, full payment of the total cost(including any insurance premiums) must be paid at the time of booking. For any accommodation booked less than 2 weeks before departure your booking must be paid for in full by debit or credit card, or by bank transfer, at the time of booking. If any payment due in relation to your booking is not paid by the appropriate date, we are entitled to assume that you wish to cancel your booking. In this case, we will be entitled to keep all deposits paid or due at that date. When a Booking is confirmed, a reservation number is given. This number must be retained for access to the Booking details if cancellation or amendment is necessary.

Prices

All published rates include VAT where applicable (and local taxes) at the current rate. Prices also include a booking fee to cover the cost of payment processing fees.

ates are for the length of the stay You selected (eg 3,4,7 nights). If You have selected supplements they will be added to the total price of the Booking. Rates do not include other costs you may choose to incur during Your stay (unless otherwise stated). If additional usage is required, payment will need to be covered by You. Rates quoted are correct only for the specific number of guests, nights and dates shown. Should You change the number of guests, dates or nights, then the rates are subject to change.

Utilities

Utilities are included in the rental rate. However, you must ensure that all lights, and heaters are turned off when you are not in the cottage. Wood is also supplied. Never leave a lit fire unattended and always ensure the fire is out when you are not in the cottage. Do not place any wood, ash, or other materials that have been in the fire in the wood store as this is a fire hazard.

Telephone

Telephone charges will be billed at cost at the end of your stay. A full breakdown will be available after your stay.

Sundries

A number of services can be organised on behalf of Us. We are merely acting as a booking agent for all Services booked through Us. Your contract will be between you and the Service Supplier offering the Optional Extras and will be subject to their terms and conditions in addition to those set out here. We accept no responsibility for the quality of these services, and any disputes will need to be taken up directly with the service supplier. All additional goods and services purchased during your stay must be paid in full on presentation of invoice at check-out.

Internet Access

Internet access is included in the cost of the property. WiFi details will be provided when you arrive. Internet is available on a fair usage policy. If, for any reason, we are unable to supply internet, eg, for a technical reason to do with the provider who supplies internet to us, or due to a fault with our equipment, we will not be liable for any loss you incur as a consequence of not being connected. You will not be entitled to any refund of your booking fee as a consequence of not having internet during your stay.

Double Booking

We take every care to avoid double bookings. However, we have several mechanisms for taking bookings including online bookings. Occasionally double bookings occur where we agree to a booking and then a subsequent booking is inadvertently processed prior to the first mentioned booking being entered into our system. In such a case, the booking first agreed to takes preference and the latter booking will be cancelled. We will not be liable under such circumstances.

Check-in / Arrival

Check-in times are specified on your booking confirmation and are usually from 16:00 onwards. Note, we make every effort to ensure apartment is prepared for check-in by 15:00 However, unfortunately from time to time exiting guests fail to comply with the requirement to check-out by 10am. Where this occurs, as a matter of practical reality we may need to delay the check-in time to allow time to properly prepare the apartment after the late check-out. Please contact Us to inform approximately what time you will be arriving to provide details of how to collect the keys.

Check-Out / Early Departure

The Check-out time is also specified on your booking confirmation and is usually 10:00am. Late checkout may be available and is dependent on availability. Please contact Us if you wish to extend your check out at least 4 days before your departure. You will not be entitled to any refund for vacating prior to the departure date set out in your booking confirmation.

Care of Property

You shall keep the Property and all furniture, fixtures, fittings and effects in or on the Property in the same state of repair as at the commencement of the holiday, and shall leave the Property in the same state of cleanliness and general order in which it was found.

Please note: We will apply an extra charge of £45 per stay if excessive cleaning of the cottage is required after a stay. An extra charge of £25 per stay will be applied if the BBQ has not been cleaned after use.

Damage and Breakages

You are responsible, whether caused directly or indirectly, for the cost of any breakages or damages to the cottage and its contents. In the event of damage to the property you will on an indemnity basis reimburse Us the cost of the repairing the damage. Any call out charges, and repair costs to services in the property will be payable if the fault is due to You or your party. Failure to remove damages/stains could result in the whole area requiring repair (eg steam cleaning or replacing carpet, repainting walls etc)

In the case of breakages you will on an indemnity basis reimburse Us the cost of replacing (as new) or repairing the damaged item or items. If you discover that anything is missing or damaged on arrival at your accommodation you must notify us immediately on 07810481881 . If you do not notify us we will assume that you caused the relevant damage or loss.

Complaints

In the event of there being cause for complaint concerning the cottage, the matter shall be taken up with Us at once. It is important that this is done whilst you are still at the Property so that an on-the-spot investigation can be made if necessary and remedial action taken if required. In no circumstances will compensation be considered for complaints raised after the holiday has ended, when you have denied the Owners/Caretakers the opportunity of investigating the complaint and endeavouring to remedy matters during the holiday. We make every effort to ensure that the property details supplied to us by the Owners are accurately reproduced. Mistakes may occur from time to time, and confirmation should be requested prior to booking. You accept that minor differences between text/photograph/illustrations in the Brochure and on the Website and the actual property may arise.

Use of the Property

You and all members of your party agree not to use the property for any unlawful or commercial purpose, including without limitation assigning or subletting it or otherwise allowing anyone to occupy it who has not previously been accepted by Us.

We are entitled at our sole and absolute discretion to refuse to hand over to you, or to repossess, the property if We reasonably believe you or any member of your party is behaving unlawfully, or that any damage is likely to be caused, has been caused or is being caused by the behaviour of you or any members or your party. These circumstances will be treated as a cancellation by You. You also must not allow more people than stated to occupy the property, neither can you significantly change the composition of your party during your occupation of the property. If you do any of these things, We can refuse to hand over the property to you, or can repossess it. If this does happen, this will be treated as a cancellation by You.

In these situations no refund of any monies you have paid in respect of your booking will be made and We will not have any liability to You as a result of this situation arising (including for example any costs or expenses you incur due to not being able to occupy the property, such as the cost of securing an alternative property/ accommodation or the payment of any compensation to you). We are not obliged to find any alternative accommodation for you.

You must allow Us and any representative (including workmen) access to the property at any reasonable time during your occupation of the property (except in cases of emergency or where a problem needs remedying quickly and you cannot be contacted in time - in these situations We are entitled to enter the property at any time without giving you prior notice).

Liability

Other than for death or personal injury caused by Our negligence or misrepresentation, Our total liability to You is limited to the price of the Booking and to the fullest extent permitted by law all warranties are excluded and in no circumstances will We not be responsible for any indirect or special damages. We will not be liable for failure to perform to the extent that the failure is caused by any factor beyond Our reasonable control. You are responsible for any damage or loss caused to Us or our Our property by Your act, omission, default or neglect and You agree to indemnify Us and to pay Us on demand the amount reasonably required to make good or remedy any such damage or loss.

Data Protection

We may process the information You provide to Us for the purposes notified by Us to the Information Commissioner. By making a Booking, You consent to this processing of information and we follow all GDPR regulations. If you have provided an e.mail address as part of booking a property, you are deemed to have received any e.mail sent by us to that address. Sending an e.mail to that address is deemed proper notice by us.

Acts of god

If your property is made unavailable as a consequence of an act of god, eg, a flood, you will not be entitled to a refund of your booking fee. You should ensure you are covered for this by your travel insurance Cleaning during your stay. The standard price does not include providing cleaning services during your stay. We can, however, arrange this for you. The cost to you is £95 per clean. This includes a standard clean and linen change.

Luggage

As we do not have a physical reception, we are not able to store luggage for you prior to your check-in time or after you check-out.

Travel Insurance

We recommend that you take out adequate travel insurance to cover you for the duration of your stay.

Disabilities / medical problems

If you or any member of your party has any medical problem or disability that may affect your booking please tell us before you confirm your booking and give us full details as early as possible before you travel. If We reasonably feel unable to properly accommodate the particular needs of the person concerned we reserve the right to decline or cancel the reservation.
